Penalties under the Building Energy Efficiency Disclosure (BEED) Act 2010 are expressed in penalty units. Under the Crimes Act 1914, the value of a Commonwealth penalty unit increased from $330 to $364 on 1 July 2026.
The penalty amounts published on the CBD website reflect the current penalty unit value of $364 and apply to conduct occurring on or after 1 July 2026.
Penalties are calculated based on the applicable penalty units for the breach.
For example:
- 10 penalty units = $3,640
- 1,000 penalty units = $364,000
For conduct that occurred before 1 July 2026, penalties will be calculated using the penalty unit value that applied at the time of the breach.
